WARRANTY, TERMS & CONDITIONS
Invoicing and Payment
An initial mobilization payment of 50% is due upon contract execution and prior to start of work. Subsequent invoicing and remaining balance is due upon receipt of completion/final installation day.
Deliverables
Southern Synthetics agrees to provide to the client:
– Start Date and potential Completion Date (not guaranteed as weather, material availability and schedule may impact the actual date)
– List of all materials and suppliers used for the installation found in provided bid
– General Warranty Information for all supplies, materials, and labor can be found in bid
– Installation can take up to a week depending on size, and services requested
– Approval request for any Change Orders
– Approval request for any necessary work outside of site preparation and turf installation, including, but not limited to, landscaping removal, electrical, structure removal, concrete, paving, etc.
Assumptions & Qualifications
– Scope/Fees assume a total turf installation of square footage included in bid.
– Scope/Fees assume a total site preparation of square footage included in bid.
– Scope/Fees are subject to change after 30 days from receipt of the proposal
– Applicable taxes have been added to the final pricing
– Proposed cost assumes the design will remain as prescribed in this proposal
– Fees assume each Phase will be completed at one time and not staggered or broken up into multiple packages other than described herein
– No additional work outside of what is included in the proposal and should not be requested directly to any onsite staff
– Additional services will be bid as a separate project with individual rates or fee structure
– All documents are produced solely in English unless otherwise stated
– Changes may be requested with approved schedule changes and include any potential additional fees
– Southern Synthetics will not be held liable for any delays caused by acts of God, weather delays, or unforeseen Safety issues
– In the event of cancelation after work has commenced, client will be billable to the total cost of a specific phase of the project and any cost incurred by Southern Synthetics relating to any fees, loss, or payments required due to a client cancelation
– Executed contract will hold all enforceable agreements including statements in this proposal
– Turf Warranty – 15 years from manufacturer Turf Hub
– Labor Warranty – 3 years for any turf default outside of general wear and tear, does not include any ongoing suggested maintenance program
– Do not cover damage caused by humans and/or animals after installation
– Irrigation/Drainage issues after completion
– Acts of God/Nature (Floods, Fires, Weather, etc.)
– HOA or Municipality restrictions
– Wear related issues including, not limited to matting
– Any matters unable to be remedied at either parties satisfaction, must be settled in the operating city of the Southern Synthetics, Dallas County
– Maintenance Program – offered at $1.50 per sq. ft. to for quarterly infill and power broom treatment based upon usage
– Southern Synthetics will not be held liable for any injury, or death (human or animal) resulting from the play, use or any type of engaging with the product or installation.
– Southern Synthetics is not responsible for any TURF MELT of any kind, the most common being caused by reflective windows. Solar screens can prevent this from occurring and should be considered.
– Seams, expansion, and contraction – our team provides a premier installation service, but cannot guarantee seams will be hidden 100%, or that due to weather you may experience ripples or gaps in transitions.
– Pets – if you currently have pets, or plan to get pets, we will always suggest to choose a turf built for medium to high traffic areas as prescribed by the manufacturer, and using an antimicrobial infill. Southern Synthetics cannot guarantee pet odors won’t develop, and will not warranty any other turf not intended for pets in these types of applications.
– Temperature – synthetic turf has the possibility to have an elevated temperature during periods of extreme heat. Southern Synthetics will not be held responsible for any injury or issues from heat or temperature.
– Owner is responsible for any approvals, including, but not limited to Home Owners Association. Any denial from governing bodies is not grounds for non-payment of services and are subject to additional charges if delays, or fees are assessed to Southern Synthetics
– Southern Synthetics will attempt to the best of their ability to protect any personal property, lawn, shrubs, plants, landscaping, landscape lights, cable lines, irrigation heads and lines, and ingress/egress areas during the installation. Southern Synthetics is not responsible for any damage(s) and/or repairs.
– Unless notated in the bid, Southern Synthetics is not responsible to move, replace, or repair any piping, sprinklers, or hidden objects. Owner is responsible for ensuring utilities, irrigation, or sprinkler do not interfere with the installation process.
– A member of our Southern Synthetics team perform a final walk. You as the client are not required to be on site, but we do highly suggest your participation and we will require a signature of completion of services.
– Acceptance of Quote includes acceptance of listed product and T&C included
